McCurdy told the committee the docket updates Idaho's rules governing generation, transport, treatment, storage and disposal of hazardous waste to reflect federal changes through the referenced date and incorporates modifications such as EPA Method 23 updates used in stationary‑source analytical work. He said the rulemaking included technical corrections and clarifications to the hazardous waste generator improvement rule, the hazardous waste pharmaceutical rule, and the definition of solid waste.
McCurdy said the notice of rulemaking was published in the Administrative Bulletin and that no written comments were received; the Board of Environmental Quality adopted the rule on Nov. 14, 2024. The committee moved to approve the docket and passed it on a voice vote.
DEQ asked the committee to approve the incorporation to maintain primacy so the state implements hazardous‑waste rules rather than EPA. McCurdy said incorporation provides a single set of rules and is effective and efficient for regulated facilities and the agency.
