House Education committee advances rewrite of school safety code to second reading

Representative Chris Mathias, who sponsored the replacement RS, told the committee the current code attempts to do three distinct things in a single paragraph and that RS32361 disentangles them. "We expect school districts to develop and maintain a safe environment for students by A, developing a system of background checks for all persons who have unsupervised contact with students. We require each school in the district to create and maintain an emergency operations plan, and we require school district staff to receive initial and annual emergency operations planning," Mathias said.
Mathias addressed earlier concerns about protecting emergency plans and related training from public disclosure by citing existing state law. He quoted statutory language and told the committee that records related to critical infrastructure are exempt from public disclosure when disclosure would reasonably jeopardize safety, and that the reference in current law includes "emergency response plans." Mathias said that citation (Idaho Code § 70-4-105(4)(b)) resolves the committee's prior concerns about adding an explicit exemption in the bill text.
Representative Garner moved to introduce RS32361 and send it directly to the second reading calendar with a due-pass recommendation. After brief remarks and no further questions for the sponsor, the committee carried the motion and the item was advanced to the floor for second reading.
The replacement language filed in RS32361 separates (1) background-check requirements for persons with unsupervised student contact; (2) a requirement that every school maintain an emergency operations plan; and (3) staff training requirements tied to those plans. Mathias said the change is intended to make each requirement clear and administrable.
The committee did not take up additional amendments during the meeting. With the RS introduced and the due-pass recommendation recorded, the item will be scheduled for further consideration on the House calendar.
