Council approves public defender request for appointed counsel and miscellaneous expenses appropriation

Adams County Council approved a request from the public defender to appropriate funds to cover outside appointed counsel and miscellaneous expenses related to conflicts and complex cases.

The public defender (identified in the meeting as Brad) told the council his office budgets historically for appointed/conflict counsel and that "$15,000 a year is a pretty conservative figure" to cover outside counsel when conflicts require assignment beyond the three full-time public defenders. He described types of cases that trigger conflict counsel, including multi-party child services cases and serious drug-related prosecutions that may require depositions and longer trials.

County staff and council discussed whether the request should be processed as a transfer or as an additional appropriation. Staff explained that money in the supplemental fund cannot be moved fund-to-fund by a simple transfer; instead the correct form is to appropriate the funds in place or submit an additional appropriation so the department can spend the money from the correct fund. Staff confirmed the supplemental account has sufficient cash; the council voted to approve the appropriation/transfer-of-appropriation as presented.

Ending: The county auditor will process the appropriation paperwork and staff will publish required notices. The public defender's office will submit outstanding bills for appointed counsel and miscellaneous expenses to be paid from the appropriated funds.
