On Sept. 10, 2025, the St. Joseph County Area Board of Zoning Appeals granted a conditional use allowing a temporary dwelling unit for a caregiver/care receiver at 21750 Jackson Road for a period not to exceed three years.
Adia Smith, area plan staff, explained that the county zoning ordinance permits a temporary dwelling for an occupant who receives weekly assistance from the primary dwelling's occupants for up to three years. Staff reported that required medical certification from a physician documenting the need and frequency of assistance had been provided and recommended approval.
Petitioner Tyler Barton, who lives at 21750 Jackson Road, said the existing roughly 700-square-foot outbuilding already has connected water, electricity and septic and that the family planned to add a bedroom and kitchen so his father could live nearby while receiving daily oversight. Julianne Stewart Heaney, who identified herself as a neighbor and caregiver, spoke in support and said she understood the importance of having a care receiver nearby.
Board member Tom Byers moved to approve the conditional use subject to the conditions in the staff report; Doctor Lauck seconded the motion. The board voted unanimously to grant the conditional use and said it will issue written findings. Staff noted that after three years the petitioner may return for renewal or must remove the elements that constitute a dwelling unit (for example, removing kitchen facilities) if the temporary status is not extended.
