On Oct. 21 the City Council denied a conditional rezoning request for 47 Owendale that would have changed the parcel from single‑family residential (R‑1) to Neighborhood Corridor (NC) to allow expansion of parking and EV charging for an adjacent gas station and repair shop at 1465 Washtenaw.
Planner Josh Burns summarized the long history of applications and litigation related to the property. Burns noted the existing business at 1465 Washtenaw currently holds a nonconforming combination of uses and that state of the zoning ordinance limits expansions of nonconforming uses. He explained that the request conflicted with the city framework map (the master‑plan substitute) that treats 47 Owendale as part of an outlying single‑family neighborhood adjacent to a corridor and that past rezoning attempts had been denied for similar reasons.
Residents and a number of council members said the property’s prior owners bought the lot knowing the use restrictions and that neighbors have long complained about overflow parking, noise and the use of the vacant lot as a vehicle staging area. One council member said the owner has not engaged well with neighbors and observed a history of noncompliance with prior court orders.
Council member John McLean moved to deny the conditional rezoning; the motion passed on roll call. The city planner told council the property owner had indicated an alternative option could be to develop a single‑family home on the lot consistent with R‑1 zoning.
