Board opens public hearing on vacating portion of 200th and 80th Street; action postponed pending recorded easement

The Pottawattamie County Board of Supervisors opened a public hearing on a proposed vacation of a roughly 180-foot portion of 200th and 80th Street on the west line of Section 2, T75N R42W. Jody Marks, project manager for Secondary Roads, introduced the hearing and identified the accompanying paperwork, including a proposed resolution (No. 65-25) that would record a final order on the vacation.
A member of the public, who identified themself as L.B. Rosenberg and gave an address of 28253 Honeysuckle Road, opposed the vacation unless an easement guaranteeing ingress and egress to remaining parcels is recorded. Rosenberg said, “I’m in agreement opposing that the balance of that dirt road. As long as I can receive a easement in and out access to the property that's already there or the the balance of my property and so on.”
County staff explained the property layout: the stretch under consideration currently provides access to three parcels owned by the same person and a fourth parcel where an owner (referred to in the hearing as Mr. Carey) is building a shed. Staff recommended that the parties record a perpetual ingress/egress easement so future owners would not be landlocked.
Board members discussed sequencing and recordation. One supervisor proposed amending the resolution to make the vacation contingent upon a recorded easement between the two affected parties; Jody Marks said she would insert verbiage making the vacation contingent on the easement and that survey and recording costs would be borne by the parties involved. After public comment and discussion, the board voted to close the public hearing and defer final action until the easement language is recorded and confirmed; the item will return to the board’s agenda next week.
The board opened and closed the public hearing by roll call with unanimous votes to proceed and then to set the matter aside pending documentation. No final order (no signature on Resolution 65-25) was recorded at this meeting.
