Millard County commissioners adopted an ordinance Oct. 25 amending the Sherwood Shores zoning district to restrict several commercial and other uses that residents said are incompatible with the subdivision's small lot residential character.
Bill Morrison, president of the Sherwood Shores Property Owners Association, told the commission the zone was created to reflect the subdivision's 250-by-100-foot lots and that the association had voted at a spring meeting to remove a set of enumerated uses. Sherry Collister, vice president of the association, said two property owners opposed the change as “more restrictive” than in prior decades, but the association representatives said the change reflected the majority of property owners.
The Planning Commission had recommended removing seven of the eight proposed uses but asked the commission to retain "seasonal use" as a permissible conditional use because it is allowed elsewhere in the county. County staff explained the definition of seasonal use is limited and requires separate permits and conditions; if the commission removes the use entirely, property owners would need a formal code change to add it back.
After discussion about balancing property rights and community character, the commission adopted the Planning Commission's recommendation (retain seasonal uses as conditional, remove the other seven uses).
