Millard County approves interlocal agreement to transfer Fillmore landfill operations to Fillmore City

Millard County commissioners voted Oct. 25 to approve an interlocal agreement with Fillmore City to transfer operation of the Fillmore City landfill to the city, including permitting, closure and post-closure responsibility and certain county equipment.
A county staff presenter described the agreement as intended to relieve the county of operating a separate station in east Millard County and to reduce pressure on the landfill enterprise fund. The agreement transfers identified pieces of equipment — including a compactor, grader, backhoe and two dump trucks — and the mitigation fund to Fillmore City. Under the proposed memorandum of understanding, the county would provide $30,000 per year for three years while the city establishes its operations; that payment would stop if Fillmore City ceases to operate the landfill.
The county will require that permitting and closure responsibilities be put in Fillmore City's name, and staff said the Utah Department of Environmental Quality (DEQ) has indicated those transfers are permissible. The agreement also includes a planned shared study of the mitigation fund and cost splits for that study; the study cost was not specified at the meeting. Commissioners voted to approve the interlocal agreement and direct staff to provide the document to Fillmore City for its council consideration.
County staff read the inventory of equipment to be transferred into the record; the equipment list includes VIN/ID information and is part of the interlocal agreement.
