Background: Under the California Streets & Highways Code, property owners are generally responsible for maintaining sidewalks adjacent to their parcels. When a property owner cannot or will not repair an unsafe sidewalk, the city can complete the work and file a special assessment (lien) against the parcel to recover the cost.
What was done: Public Works staff reported the city completed removal and replacement of 189 square feet of sidewalk, 24 square feet of asphalt patching, temporary traffic control and root removal under the former sidewalk. Deputy Director of Maintenance Operations Greg Cruz said the replacement "was installed in compliance with city standards and ADA requirements and the total cost for the work was $17,166.59." The owner had asked the city to perform the work due to contractor scheduling conflicts and financial constraints; staff completed the repairs on Aug. 12.
Council decision: Staff originally proposed filing the assessment with interest based on Municipal Code section 12.12 (10 percent). Vice Mayor Shorzman and several council members urged a lower rate. After discussion, the council set the assessment interest at 5 percent and confirmed the work-completion report; the property owner will have five days after notification to pay the assessment before a lien is recorded with the County Recorder.
Next steps: Staff will notify the property owner of the confirmed assessment and the owner may either pay the assessment within five days of notification or allow the city to file a special assessment lien on the parcel. Council discussed directing staff to review comparable market rates when recommending interest in future cases.
