Commission asks State Board to begin rulemaking to update Policy 2.9 on emergencies, transformation and statutory citations

The Commission on School Accreditation voted Oct. 14 to request that the State Board of Education begin the Administrative Procedures Act process to revise Policy 2.9 of the Mississippi Public School Accountability Standards 2025. The proposed changes update the policy to reflect 2024 changes in state law, clarify notification and board-approval steps when districts are placed into transformation, and correct statute citations.
"Policy 2.9 . . . addresses the process for a declaration of the state of an emergency and the ability for the NDE or the state board to place a district into transformation and withdraw the accreditation status of the school district," Dr. Joanna Malone said, explaining that the 2024 legislative session made statutory changes that were not set to take effect until 2025 and that the policy update aligns the commission's rules with that statute. She said the edits also reflect the statutory abolition of the Achievement School District.
Commissioners discussed adding explicit statutory citations to the policy language. One commissioner suggested inserting "37-17-6" and clarifying a subsection reference ("12(c)") so the policy's authority language directly points to the relevant code provision; Dr. Malone acknowledged the suggestion and said staff would check for typographical omissions and aim to correct citations before the item goes to the State Board.
Commissioner Carter Myers asked about the addition that requires notifying a district when the board determines it should be placed into a district of transformation; Dr. Malone said the language was added "to clarify that we have to notify the district" and to provide a timeline for notification so a district is informed before action is finalized.
A commission member moved to request the State Board begin the APA process to revise Policy 2.9 "with the noted amendment"; Carter Myers seconded. The commission voted in favor and the motion carried.
Commission staff said they would attempt to correct statutory citations and related edits prior to the State Board meeting scheduled for Thursday.
