Rawlins approves perpetual easement to allow immediate work on Edinburgh Street project

The Rawlins City Council voted 6-0 to accept a perpetual easement related to the Edinburgh Street project and authorized the mayor to execute the acceptance form; the city attorney was directed to record the easement.
City Attorney Maderoy explained the legal need: because the affected segment of Edinburgh Street crosses private property, state law requires property authorization for the city to construct or maintain public infrastructure. The perpetual easement grants the city access to build and maintain the road and infrastructure "above and below this area," she said, and is the first step toward bringing the area under the city’s maintenance authority.
Maderoy said the work will improve a dirt road segment that currently is in poor condition and limits safe access for traffic and emergency response vehicles. She added the city is negotiating boundary line adjustments and eventual conveyance that would separate the property into three parcels and permit full conveyance to the city over time.
By approving the easement now, the city will be able to start work once the construction contract is awarded. The motion to accept the perpetual easement was moved by Council member Zenger, seconded, and passed by online vote, 6 yays.
