Commission issues notice of intent to annex parcels into Zion Mountain local service district, sets tentative Nov. 18 hearing

The Kane County Commission approved Resolution R2025‑29, a notice of intent to annex adjacent properties into the Zion Mountain Local Service District, contingent on the county attorney’s review to ensure the document complies with local service‑district rules.

Commission staff and representatives of Zion Mountain explained the proposed annexation map (existing district shown in red, proposed additions in yellow) and said the expansion is intended to support wastewater and other infrastructure that underpins planned development, including a discovery center and related redevelopment activities. Kevin McClause, a Zion Mountain board member, said the district wants consistency across services and that the yellow parcels were acquired after the district was formed.

Commissioners and staff discussed technical differences between a local service district and special service districts and asked county legal counsel to confirm the required notice and protest procedures. The commission asked staff to publish required notices (a 35‑day notice period was explained) and then hold a public hearing, followed by a 60‑day protest period and a final decision if no valid protests are filed.

The commission approved the notice motion unanimously, with commissioners asking the county attorney and clerk/auditor to coordinate legal wording and the hearing schedule. Staff proposed a tentative public‑hearing date of Nov. 18 at 6 p.m., subject to final legal review.
