Madison Heights City Council on Sept. 29 conducted the first reading of Zoning Text Amendment ZTA 25‑01, which would allow certain legally nonconforming residential driveways to be replaced "in kind" without forcing property owners to bring the full site into current code standards.
Staff said many single‑family driveways in Madison Heights predate the new zoning ordinance and are legally nonconforming; under the current ordinance, replacing a nonconforming driveway could require owners to redesign their sites or seek a variance from the Zoning Board of Appeals. Planning staff told council the proposed text amendments to sections 7.31, 10.21 and 13.106 aim to streamline routine driveway replacement and reduce the number of hardship variance requests.
The planning commission held a public hearing Sept. 19 and recommended approval of the amendments as presented. On motion, the council scheduled the second and final reading for the Oct. 13 council meeting.
Councilors recorded no substantive opposition during first reading, and staff will return with the final ordinance language for adoption at the Oct. 13 meeting.
