The Shelton Planning and Zoning Commission on Aug. 27 voted unanimously to rescind a prior approval for an accessory dwelling unit at 395 Shelton Avenue after staff found discrepancies in the property ownership documents submitted with the earlier application.
Chair Virginia Harger told the commission staff had discovered the building-assessor information showed ownership by an LLC, while documents filed with the ADU application identified an individual as the owner. Staff then received an authorization letter from the LLC’s agent only after the Aug. 14 meeting. Commissioners said the late clarification made the original approval unreliable and moved to rescind and deny the application without prejudice.
On a roll-call vote the motion to rescind the earlier approval and deny the application passed 6-0. Commissioners indicated denying without prejudice would allow the property owner, acting through the LLC or its authorized agent, to submit a corrected application in the future.
Commission members asked whether application fees should be waived if the property owner files a corrected application; staff said fees had not yet been paid and therefore waivers were not necessary. No further action or appeal timeline was set during the meeting.
