Commission to review subdivision regulations; Plan Rutherford remains a commission-adopted guide pending county commission action

At the end of its Sept. 22 meeting, the Rutherford County Regional Planning Commission discussed a review of the county subdivision regulations and received clarification about the legal status of Plan Rutherford, the recently adopted comprehensive plan.
Staff said Mayor Carr asked planning staff (Doug and Mike) to review subdivision regulations thoroughly and present recommended corrections or overhauls. Commissioners were invited to submit specific suggestions (for example, block length or parking rules) to staff for review; staff said the process will take time and will involve legal review.
County counsel (Nick) explained the legal status of Plan Rutherford: the planning commission adopted Plan Rutherford to supersede the prior comprehensive plan (2011) and that action makes Plan Rutherford the commission—s comprehensive plan guide. However, Nick said Plan Rutherford has not yet been formally adopted by the elected county commission. He explained that if the county commission chooses to formally adopt Plan Rutherford, the plan would carry more weight: rezonings and land-use actions would need to conform strictly to the adopted plan. As of Sept. 22 staff said plan Rutherford would be transmitted to the county public works committee for consideration, which would include another public hearing before any county legislative adoption.
Ending: Commissioners were asked to provide input on subdivision-regulation changes; staff and legal counsel will coordinate the process and advise whether proposed regulatory changes are legally permissible and practical before forwarding recommended changes to the commission and the county commission as appropriate.
