Public hearing on closing portion of CPCC Lane deferred after commissioner recusal

The Town of Matthews held a public hearing Sept. 22 on a petition from Central Piedmont Community College to abandon and transfer maintenance of a portion of CPCC Lane that dead-ends near I-485, but the board deferred a decision to the Oct. 13 meeting after a commissioner disclosed a potential conflict.
Susan Habena Willard, the town engineer, told the board the right-of-way petition was for a section of CPCC Lane that was severed during construction of I-485 and that CPCC owns the adjacent property on both sides of the roadway. Willard said the petition to the N.C. Department of Transportation seeks to have NCDOT abandon maintenance responsibility and for the maintenance to be transferred to the adjacent property owner.
During the public hearing period, Commissioner Renee Garner disclosed consulting work for NCDOT and asked whether she should recuse herself. After discussion the board concluded Garner should recuse from related decision-making and recognized that with that recusal the board lacked the votes to take action at the Sept. 22 meeting. The mayor announced the board would hear comments and reschedule the formal resolution discussion for Oct. 13.
Town staff described the next procedural steps: NCDOT will accept the board's statement of whether the abandonment is contrary to the public interest and whether affected property owners would be deprived of access; a future resolution of support from the board would be forwarded to NCDOT along with public hearing documentation.
Commissioners and staff said the Oct. 13 date would be used to complete the record and vote on whether to transmit a resolution of intent to NCDOT.
No substantive decision on the abandonment was made Sept. 22. The matter was carried over to ensure decisions are made with a full and impartial quorum.
