Clearfield Council approves CDBG CAPER, updates mural code, ratifies opioid settlement and signs logo agreement

The Clearfield City Council on Sept. 23 unanimously approved four formal items: the 2024–25 Consolidated Annual Performance and Evaluation Report (CAPER) for Community Development Block Grants, an ordinance amending Title 15 of the Clearfield City Code to address murals, ratification of a national opioid settlement with Purdue Pharma and members of the Sackler family, and an interlocal agreement allowing the city to use the America250 trademark logo.
The CAPER, presented by staff member Allison, reported $348,077.13 spent across public services, arts-center improvements, parks/aquatics updates and administration, leaving a balance of $57,373.41. Council voted to approve the CAPER and authorize any necessary signatures.
Council then approved ordinance 2025-520 to retitle and revise Clearfield City Code Title 15 (public art → mural art). Staff member Spencer explained the main edits: change the chapter title to “mural art,” remove a blanket prohibition on text/slogans/logos while explicitly barring advertising messages as defined in the code, require a scaled visual mock-up with permit applications (and drop the requirement for hard-copy concept plans), and correct grammatical errors. Council discussed whether recognition or sponsor marks required by outside funders—in the example cited, the Discover Davis mark used for county matching grants—would be treated as advertising; staff and council described that the county mark was intended as a sponsorship/recognition element rather than a commercial advertisement. Council moved and unanimously adopted the ordinance and authorized signatures.
Stuart, a city staff member, briefed the council on a requested ratification to join a national opioid settlement involving Purdue Pharma and the Sackler family. Stuart said the nationwide settlement totals roughly $7.4 billion, with Utah slated to receive about $57 million; the Sackler payments are described as $6.5 billion to be paid over 15 years and Purdue providing roughly $900 million once bankruptcy proceedings conclude. Council voted to ratify the city’s participation and authorized signatures.
Staff also requested approval of Resolution 2025 R-12, an interlocal agreement with the State of Utah27s Department of Cultural and Community Engagement allowing Clearfield to use the America250 trademark logo. Staff clarified the agreement governs logo use; the council approved the resolution and authorized signatures.
