County planning staff presented a preliminary plat for Grove Hill Subdivision, a 38-lot residential development proposed off Whichburg Road, and said the plan "meets our specifications," including stormwater requirements. Staff told commissioners the plan includes two retention ponds intended to address drainage concerns.
Jeff Tomlin, the adjacent landowner, asked the commission to ensure the developer would not remove a tree line that separates his property from the proposed subdivision. Tomlin said, "we won't leave the tree line. It separates our land from the subdivision." County planning staff responded that if a developer meets the county's specifications, the county cannot deny a subdivision application based solely on a request to keep vegetation; if trees were disturbed on someone else's property, that would be a private property dispute between the property owner and the contractor. As planning staff put it, "If they disturb trees on somebody else's property, that would be between the property owner and the contractor to work that out legally. The county would not be involved in that." Staff also said the county monitors work through the land-disturbance process to ensure contractors follow approved plans.
Commissioners placed the preliminary plat on the meeting agenda for further consideration; no formal approval of the plat was recorded in the transcript at this meeting.
