The hearing examiner on Sept. 25 acknowledged a series of petition withdrawals and continuances, granted a limited waiver of notice for two expedited petitions, and recommended several petitions for placement on the Metropolitan Development Commission agenda.
Procedural outcomes included acknowledgments of withdrawn filings, multiple automatic continuances requested by registered neighborhood organizations, and staff-requested continuances to allow additional review or to incorporate amended petitions that required new notice.
Among expedited items, the examiner granted a two-day waiver of written notice for companion petitions 2025ZON086 and 2025VAR004 at 5255 Winthrop Avenue after the petitioner reported prior written notice and neighborhood association support; staff did not object. The examiner recommended approval of 2025ZON086 and granted 2025VAR004, and said the items would be placed on the Metropolitan Development Commission agenda for Oct. 15, 2025.
Other outcomes at the hearing included staff and petitioner requests for continuances. Representative examples (petition ID : outcome and note): 2025APP012 : continued to Oct. 9 (sign package portion withdrawn and to be refiled); 2025MOD019 : continued to Oct. 9 (staff request); 2025ZON071 : withdrawn (petitioner withdrew petition); 2025ZON074 : automatically continued to Oct. 23 (registered neighborhood organization filed); 2025ZON095 : automatically continued to Oct. 23 (registered neighborhood organization filed); 2025ZON096 : withdrawn (petitioner requested withdrawal); 2025CZN/CVR832 (companion petitions) : continued to Oct. 9 at petitioner's request; 2025CZN/CAP836 : continued to Oct. 9 (staff requested continuance to allow review of technical materials); 2025CPL/CVR843 : continued to Oct. 23 with new notice required (petitioner amended the request); 2025ZON094 : continued to Oct. 23 (petitioner requested more time to meet with neighbors); 2025APP003 (620 E. 20th St.) : continued to Oct. 23 (staff request); 2025ZON091 (6154 Michigan Road) : continued to Oct. 23 at remonstrator's request after last-minute contact with staff.
The examiner also recommended approval, subject to commitments, of several petitions slated for the Metropolitan Development Commission agenda: 2025MOD020 (1011 E. 20th St.; sign plan modification) recommended for MDC placement Oct. 15; 2025ZON093 (1849 Broad Ripple Ave., rezoning to C-1) recommended approval by staff and examiner subject to recorded commitments excluding 25 specified uses; 2025ZON054 (126 and 130 Coney St., SU-1 RCTOD rezoning) recommended approval subject to a commitment to install sidewalks along Everett Street. Several continuances were explicitly acknowledged as automatic continuances filed by registered neighborhood organizations.
The hearing examiner handled the expedited docket by swearing in petitioners en masse, inviting brief presentations and acknowledging staff'recommended approvals where no opposition was known. When remonstrators appeared unexpectedly on expedited items, the examiner granted continuances where appropriate to allow additional negotiation and neighborhood engagement.
Many matters were continued to the Oct. 9 or Oct. 23 hearing dates to allow staff and petitioners to complete technical reviews or to provide new notice to affected parties. Several petitioners said they planned to meet with neighborhood associations before the next hearing date. The items continued or recommended for MDC consideration will appear on future hearing-examiner or MDC dockets with dates indicated at the hearing.
