Project summary: The proposal (SB2025-009) requests approval of a preliminary plan for 136 residential lots and 11 tracts on approximately 39.5 acres. The site plan keeps the western half of the parcel as open space within the Cherry Creek flood plain and locates houses and internal streets on the eastern portion. Units include single-family detached, cluster-detached single-family and duplex lots; the plan complies with the Pine Tree Meadows PD approved in February 2023 and provides a 20-foot landscape buffer along the northern boundary.
Water-appeal issue: Douglas County zoning resolution section 18a requires inclusion in a water district at the time of preliminary plan approval. The applicant requested an appeal to defer formal inclusion until final plat recordation because the Pinery Water and Wastewater District’s process for accepting inclusion was not complete at the time of the preliminary- plan filing. Planning Commission recommended approval of the appeal with a condition that evidence of district inclusion be provided prior to final plat.

The board approved the water-appeal with the single staff condition: evidence of district inclusion must be provided prior to the Board meeting on the final plat request. The board also approved the preliminary plan subject to 11 standard conditions, including payment of cash-in-lieu fees for parks and schools, establishment of HOA/metro district for tract maintenance, recording of required easements and final technical corrections.
Public comment and environmental notes: Referral comments and limited public comment focused on landscape buffering and building orientation; one neighbor asked staff to confirm the project would respect existing vegetation. Staff noted the potential for a bald eagle nest in the floodplain area and included wildlife measures and a burrowing-owl study requirement if construction-disturbing work occurs during breeding season.
What’s next: Applicant will continue coordination with Piney Water and Wastewater District and must provide evidence of formal inclusion before the Board considers the final plat. Technical corrections and required fees must be completed prior to final plat recordation.
