Commission approves variance to reestablish historic lot at 509 Roosevelt Street with 7.5-foot adjustment

The Oregon City Planning Commission on May 22 granted variance VR00-03 to reestablish an existing historic lot at 509 Roosevelt Street that is smaller than the R-6 minimum lot area.
Planning staff explained the request and cited the municipal code. "Oregon City municipal code section 17.12.050 states, 'an existing lot of record with a minimum lot size of 5,000 square feet ... An existing lot with an area of less than 5,000 square feet is subject to variance procedures pursuant to chapter 17.60,'" staff (Mr. Bullion) said, reading the relevant code language to the commission.
Staff reported the lot was originally platted in 1912 as a 45-by-100-foot parcel (4,500 sq ft) and that the tax-lot configuration later combined multiple platted lots into a single tax lot. Staff noted a building official's concern that, as drawn, the existing house would sit only two feet from a newly reestablished property line. To address that concern, staff recommended a condition requiring the applicant to process a lot-line adjustment that would provide at least a 3-foot setback, and the applicant agreed to a larger 7.5-foot adjustment during the hearing.
Rob Young, the applicant representative, told the commission the applicant plans to move the reestablished line "7 and a half feet" so the newly created lot will be a 60-by-100-foot parcel and that the concrete patio slab bisected by the line would be removed.
The commission approved the variance with one condition: the applicant must apply for and complete a 7.5-foot lot-line adjustment so the existing house on Lot 14 meets building-code setback requirements. The motion carried unanimously; the record shows votes recorded as: Commissioner Vergahn, aye; Commissioner Surratt, aye; Commissioner Carter, aye; Commissioner Arzen, aye; Chairperson Hewitt, aye.
Planning staff noted that, once the lot-line adjustment is processed and documented with the county assessor, the reestablished lot may be used for a single-family dwelling but must meet all applicable setback rules and building-code requirements.
