Monroe County adopts stormwater ordinance updates to align with state permit

The Monroe County Board of Commissioners voted to adopt draft updates to the countystormwater management ordinance after hearing staff explain the changes required by a new state law and the IDEM construction stormwater general permit.
County staff told commissioners the draft is a redline version showing deletions and additions made to reflect House Bill 1037 and to ensure the county ordinance is no more stringent than the IDEM construction stormwater general permit. Staff said the state permit limits the construction-focused requirements to sites disturbing one acre or more, or smaller common plans of development, and that the county preserved local standards where the permit allows it; the county kept illicit-discharge provisions because staff said those are not subject to the one-acre limitation.
The board conducted a voice vote after no public comment and approved the updated ordinance. A commissioner noted state rulemaking continuing next year could clarify some items in the new permit.
The changes are intended to bring the county ordinance into exact alignment with the IDEM construction stormwater general permit and to identify where county standards remain applicable. County staff and legal counsel reviewed the draft and told commissioners the revisions narrow the local ordinance to the situations the new state requirements authorize while retaining local standards where allowed.
The ordinance adoption took place during the boardmeeting in the Nat U Hill Room on Sept. 3, 2025; commissioners approved the draft updates by voice vote after a motion and second were made and no members of the public spoke on the item.
The board directed staff to monitor the statepermitting process next year for additional clarifications.
Ending: The adopted ordinance revisions take the county code into closer conformity with state construction-stormwater permitting; the county will track forthcoming state permit changes that staff said may resolve remaining uncertainties.
