Middletown zoning board grants 6-month extension for Orange Terrace variance

The Middletown Zoning Board of Appeals approved a six‑month extension Wednesday for an area variance on the Orange Terrace property, allowing the owner more time to complete engineering and surveying work.

Todd Mirzio, an engineer with Fusco Engineering, told the three board members present that the applicant, Moses, had experienced repeated design and surveying revisions and that a six‑month extension would be sufficient. "He was looking for a 1 year extension, but we feel 6 months extension would be adequate and sufficient time for him to proceed with engineering," Mirzio said.

The extension applies to an area variance originally granted on March 19 that involved a roughly 2.9‑foot variance on lot widths. Counselor Rich Krogan characterized the request as reasonable given the project’s delay: "The project has been in a standstill. It's not unreasonable request to ask for an extension." Board members asked whether ongoing engineering changes would alter the previously approved plans; Mirzio replied they would not, saying there would be no significant changes to house locations, drainage or sanitary systems.

Because only three of the five board members were present, the chairman noted that any determination would have to be unanimous. Member Keith moved to approve the six‑month extension; Member Tracy seconded. A roll call produced yes votes from Keith, Tracy and Chairman Jim Burdes, and the board approved the extension.

The extension allows the owner additional time to finalize engineering and surveying without returning to the board so long as the approved parameters are not altered. No further conditions or follow‑up were recorded in the meeting minutes.
