Cullen said the county and courts have considered the issue in multiple proceedings. He told the board, "In early 2010, judge Johnson ruled on our case. His decision stated our property border was private property, not a public road." Cullen said his family filed a complaint earlier, in February 2008, and disputed other dates and facts he said appeared in appellate materials.
Cullen described interactions with neighbors he named as Hutchinson and a neighbor, Gary Besto, and said he was told by county public works employees about options for road routing at a county hearing. He said clearing and fill activity took place along his property's east border while he was out of town and called that activity a trespass. "What delineation did the county conduct, and can I get a copy?" Cullen asked the board, and he requested a copy of the county's wetland delineation for the fill area.
He also accused the county of not adequately addressing wetland impacts despite having a wetland delineation showing live vegetation under the fill area. Cullen urged the board to consider that an alternate road upgrade (Jarvey Road) would have benefited more taxpayers and said he still has ongoing impacts to his property.
