The Ypsilanti Planning Commission voted to deny a conditional rezoning request for 487 Owendale that would have rezoned the R-1 parcel to Neighborhood Corridor to permit expansion of parking serving the adjacent gas station and auto repair business at 1465 Washtenaw.
Staff presented a lengthy history of the property, noting court-ordered site plans and prior rezoning attempts in 2009 and 2021 that were withdrawn or denied because the proposed land-use changes conflicted with the city master plan and the character of the surrounding outlying neighborhood. Planner Josh explained that the R-1 zoning is intended to preserve low-density single-family character and that the city framework map designates the parcel as an outlying neighborhood where nonresidential uses should be at the edge rather than embedded within residential blocks.
Staff flagged controlling ordinance language (including sections addressing nonconforming uses — cited in the presentation as 122.348 or 122 3 48) that limits expansion of nonconforming repairs and commercial uses. The planner advised that rezoning and parking expansion would effectively permit an encroachment of commercial activity into a single-family block and could conflict with development trends and property values.
Applicant Adam Musa said his family’s business owns the adjacent filling station and described prior court actions, archival lot irregularities and the company’s intent to consolidate nonconformities across three lots and provide EV chargers and ADA considerations as voluntary conditions. Musa said outreach included mailed flyers and a survey reporting a high positive response rate among contacted neighbors.
Commissioners debated whether denial perpetuated vacancy or whether rezoning would create an unwelcome commercial intrusion. Several commissioners expressed concern that expanding the nonconforming commercial use into a residential lot would conflict with zoning rules and the master plan. The motion to deny the conditional rezoning passed on roll call: Commissioner Jones Chance — yes; Commissioner Davis Jr. — yes; Commissioner Hollyfield — yes; Commissioner Smith — yes; Commissioner Woodring — yes.
Outcome: conditional rezoning for 487 Owendale — Denied. No site plan or rezoning change was approved; staff recommendation for denial was adopted.
