Commissioners postpone vote on zoning change to allow daycares in RCA overlay

St. Mary's County commissioners on Sept. 23 heard an informational presentation from planning staff on a proposed text amendment to allow use type 28 (daycare, non-medical) within the Resource Conservation Area (RCA) overlay. Staff said the public hearing on the amendment was held Sept. 9 and that four speakers supported the change; no written comments were received.
Because the RCA program is governed by the Critical Area Commission, county staff met with the IAC's critical area program committee on Sept. 19 to "take their temperature," staff said. The committee suggested minor clarifying edits to the draft amendment, including specifying that buildings must exist as of the effective date of the amendment and that the buildings be legally permitted.
County staff said the applicant accepted the minor edits and recommended postponing the final vote to Sept. 30 so the ordinance text can be updated and the edits highlighted to the Critical Area Commission, improving the amendment's chance of approval. Commissioners agreed to postpone the decision one week and requested staff return with revised language.
