The Willows City Council on Aug. 26 adopted a resolution declaring three city-owned parcels exempt surplus land and authorized staff to take the administrative steps required under state law to offer the properties for sale.
Staff told the council the resolution makes findings that allow the city to proceed without the full Surplus Land Act disposition process; staff also explained the required next steps: publish the resolution, post notices on the properties, and hold a public hearing to receive protests before any sale. The resolution would also send findings to the California Department of Housing and Community Development (HCD) to support the exemption.
If the council proceeds to sale after required notices and hearings, staff recommended offering two residential parcels to the current tenants first at appraised value, with a 30-day right of refusal. If tenants decline, staff would market the properties using a broker and, if necessary, return to council for approval of any sale substantially below the appraised value (statutory thresholds would require council review for a sale price below appraisal by certain percentages).
Council discussed technical corrections to assessor parcel numbers in the resolution and the exhibits and asked staff to correct the title and APN references before signature. A motion to adopt the resolution (with a corrected APN listing) passed 5–0.
Ending: Staff will publish the required notices, set the public hearing date for protests and proceed with the notice-and-sell steps; the resolution authorizes staff to continue the process but sale will not occur until required notice, hearing and statutory timeframes are satisfied.
