The Winter Springs Code Enforcement Board on Sept. 23 amended a prior compliance order for property at 206 Cottonwood Drive (case 2025CE0000238) and set a new compliance deadline of Oct. 1, 2025. The original order had required compliance by July 31 and set a daily civil penalty of $200 per day beginning Aug. 1 if the permit was not issued and final inspections completed.
Inspector Chris Alban summarized the case history: the board previously found the respondents in violation of Florida Building Code §105.1 for construction of an accessory structure without a final permit, issued an order requiring correction by July 31, and directed that fines of $200 per day would begin Aug. 1 if the order were not met. Alban told the board that as of Sept. 19 the permit application remained under review in the permitting system and that he could not view specific review comments with his access level. He provided the residential permit number (Residential 20252948) for the record.
The respondent, Joseph Areola, said that the only outstanding item to obtain permit issuance was a professionally sealed engineering drawing, which he had received and attempted to submit the same day as the hearing. Areola said he had been delayed because of travel for work but that he had the required drawing and intended to submit it.
Board members discussed options: reduce fines, extend the compliance date, or table the matter. The board voted to shift the compliance date to Oct. 1, 2025. Counsel and staff clarified that the board could extend the date but not increase the original fine; if the property remains noncompliant after Oct. 1 the original order’s $200/day penalty will accrue from that date forward.
The board asked the respondent to confirm permit submission and to maintain communication with the permitting office and inspector Chris Alban; the board cautioned that further leniency would be limited.
