Common Council approves correction to annexation legal description; resolution 25-037 passes 9-0

The Elkhart Common Council on Aug. 18 voted unanimously to adopt Resolution 25-037, which corrects a typographical error in the legal description connected to Ordinance No. 6,047.
City Corporation Counsel John Reinke told the council the change corrects a drafting error in the legal description prepared by the survey company and does not alter the identity or location of the property being annexed. "It's not the type of typographical error that would necessarily require a resetting of the ordinance process," Reinke said, adding that the legal description as corrected would allow a reader to determine what property was being annexed.
No members of the public spoke on the resolution. After Reinke answered questions, the council clerk conducted a roll-call vote. Council members Holt, Curry, King, Mishler, Fish, Hines, Crabtree, Henke and Council President Dawson voted in favor; the vote was 9-0.
The resolution was limited to correcting the typographical/legal-description error Reinke described. The council did not amend Ordinance No. 6,047 itself beyond the clerical correction authorized by the resolution.
The measure clears the clerical issue in the property description; the council did not debate broader annexation policy or other changes to Ordinance No. 6,047 during the meeting.
