The Boone County Board approved a special exception and variance to create three residential lots from a 15‑acre parcel at 129 South 700 West, contingent on drainage and driveway conditions and recorded commitments preventing further subdivision.
Staff reported the health department had received and signed off on soil tests for the proposed lots; it recommended perimeter drains and cautioned that basements are not recommended on the lots given local conditions. Surveyor comments require first‑floor elevations 15 inches above the centerline of the road and placement/inspection of tile connections; only one connection to the county tile will be allowed for the minor plat and that tile must be installed prior to approving drainage permits. Planning staff recommended adding no‑access and right‑to‑farm language to the plans and requiring a maintenance agreement for the shared driveway.
Attorney Mike (on record) said the conditions are already incorporated on the draft plat; petitioner William Regal confirmed plans to build a home and that family members plan additional homes on the parcel. Board members asked about shared‑driveway documentation and staff explained plat language or covenants and restrictions are typically used; the applicant will provide the maintenance agreement prior to final platting.
With technical comments to be addressed and the driveway agreement in place, a motion to approve the special exception and variance passed unanimously. County staff will require the required drainage and driveway permits before any building permits are issued and will verify tile field locations and connections during inspections.
