Marshall County Drainage Board — Sept. 15, 2025 — The Marshall County Drainage Board approved a variance that allows Crossroads Church to place the northeast corner of a building addition about 8 feet into a 75-foot regulated maintenance easement.
The request was presented by Brad Mosnitz of Abbot Marsh Consultants, who said Crossroads Church plans to add on to the north side of the building and that the proposed corner would encroach roughly 8 feet into the easement. Scott Ewing spoke for the church. A board member moved to approve the variance and another board member seconded; the board voted "Aye" and the motion passed.
The variance clears the way for construction but prompted discussion about access for ditch maintenance and the condition of an adjacent driveway. The county surveyor noted a prior variance: in 2013 the church received a 30-foot variance when the lot was gravel. Surveyor commentary and field checks indicate the parking area has since been paved; the closest blacktop is now about 18 feet from the top of bank, a distance the surveyor said would make operating heavy equipment difficult without damaging pavement.
A board member told the applicants, "If we have to clean that ditch and your black top is tore up, it's not our responsibility," and the board required that the church accept responsibility for repairing any driveway or pavement damaged during future maintenance. Board discussion also noted that, with the approved encroachment, approximately 67 to 69 feet of easement width will remain available for work.
After the vote the board directed staff to prepare paperwork for the applicants to sign; the signed document will be recorded with the property. Brad Mosnitz told the board the church and the contractor (BJ Construction) were available to answer questions during the meeting.
The board recorded the motion as approved; no individual vote tallies or member names were recorded in the meeting transcript aside from the verbal "Aye" when members voted.
