Commissioners accept Top of the Hill Farm bid for county hoop house removal; sealed-bid process questioned

Carroll County commissioners opened sealed bids for removal of a county-owned hoop house on Sept. 22 and accepted a $1,849 bid from Top of the Hill Farm (Patton of Wolfeboro). The commission discussed an earlier bid of $1 that a commissioner questioned as to whether it represented a valid sealed bid; the board concluded the Top of the Hill Farm bid met the requirements and voted to award the removal and associated obligations (including removal within 30 days) to the high bidder.

During the bid-opening, the chair read bids aloud and noted conditions in the submission requiring removal within 30 days. One attendee objected to the procedural propriety of a $1 bid in a sealed-bid process and asked whether commissioners had the right to reject or decline that submission; commissioners explained that the sealed-bid instrument is interpreted by the board and that qualifying conditions in the advertised terms control the award. Ultimately, when a motion was made to award to Top of the Hill Farm, commissioners voted in favor and the motion carried.

Commissioners commented on the unorthodox nature of some bid language and reserved the right to interpret bid terms in line with the advertised conditions.
