Legal counsel says state law change ends automatic referral back to planning commission

Hamilton County legal counsel informed the Planning Commission that a state law change passed last spring ends the former process under which a matter could be returned to the Planning Commission if the County Commissioners rejected the commission's recommendation.
"Now it goes to the commissioners and whatever the commissioners do, that's the end of the process," the legal counsel said, noting the commission had not met since the legislative session ended. Counsel added that the new legislation also tightened associated timetables.
The statement was delivered as part of the legal counsel report and was informational; the commission did not take formal action on the counsel's remarks. The change means the planning commission's recommendations will not automatically result in a subsequent planning-commission review if commissioners act contrary to the recommendation.
The commission's next meeting was noted in the session as scheduled for October 15.
