The Hialeah Planning and Zoning Board approved a conditional use permit allowing a kindergarten (maximum nine students) to operate in conjunction with an existing 42-child daycare at 2920 East Fourth Avenue, subject to conditions including a recorded declaration, a six-month timeline to obtain a change of use, and reconfiguration of parking spaces to eliminate unsafe backing onto East Fourth Avenue.
Planning staff said the building has a valid certificate of occupancy for a daycare center and that a kindergarten grade had operated at the site for the last eight years. The site currently provides six parking spaces, which staff said meets the current minimum calculation for the combined uses; however, two of the spaces fronting East Fourth Avenue were shown as backing out into the avenue. Staff required that two parking spaces facing East Fourth Avenue be realigned to eliminate backing directly into the busy avenue; one space facing East Fourth Avenue will remain with a variance allowing backing into the avenue as a minimum accommodation.
Applicant representative Al Cruz (Fire Consulting Group) presented site photos, a life-safety floor plan and a small on-site circulation plan showing the proposed reconfiguration. Staff recommended approval with conditions that include a recorded declaration limiting the daycare to a maximum of 42 children and the kindergarten to a maximum of nine students, obtaining a change of use within six months and realigning the two parking spaces fronting East Fourth Avenue.
The board approved the CUP and variances with conditions (motion by Missus Enriquez; second by mister Ilesias). The board recorded affirmative votes and the item was approved with conditions.
