CCB authorizes service of two complaints alleging underage entry or purchase by alleged under-21 patrons

The Cannabis Compliance Board voted Sept. 18 to authorize service of two proposed complaints alleging violations of NRS 678A.510 involving the entry into, or purchase from, licensed retail cannabis facilities by persons under age 21.

Emily Bridal, senior deputy attorney general, told the board the proposed complaints were prepared by the Attorney General’s Office and that identifying information has been redacted from the board packet. Bridal said that deputies from the Attorney General’s Office reviewed the evidence and recommended proceeding with disciplinary action.

For respondent A the board voted to authorize service of the complaint after Member Durette moved to approve and Amber Berry seconded; the motion carried without recorded opposition. For respondent B Member Maserana moved to authorize the executive director and the Nevada Attorney General’s Office to serve the complaint and proceed with disciplinary action; a second was received and the motion carried.

Bridal told the board that the cases are unrelated and that the board must select from three statutorily enumerated options: decline to proceed, authorize settlement negotiations with return for report, or proceed with disciplinary action. She also noted that even if the board authorizes disciplinary action, respondents may still engage in settlement negotiations and a written order is available for the board to memorialize its determinations.

The board’s votes authorize the Attorney General’s Office to serve the proposed complaints; the board did not adopt discipline at the meeting and the respondents’ identities will be revealed only if the board votes to proceed and the complaint is served.
