Commission approves expiration date for Traditions Casino special-use permit, requires building-permit application by 12/31/2030

The Lyon County Board of Commissioners approved a change to condition 23 of the Traditions Casino special-use permit on a 5-0 vote, adding a firm deadline for beginning construction activity.

Lisa Nash, senior planner with the county, told the board the casino’s special-use permit dates to a 2008 approval under an older development code and has been subject to annual compliance reviews. Nash said the amendment would replace the outdated annual review requirement with a single expiration rule: if Lucas Homes and Development LLC or a successor has not applied for a building permit for the casino by Dec. 31, 2030, the approval will expire.

Nash said staff supports the five-year window because the applicant has made infrastructure investments — including backbone roads and water/sewer installed in the rights-of-way — but the county should not indefinitely hold a long-open entitlement. “If they do not meet that date … their SUP would be null and void,” Nash said during the presentation.

The applicant’s representative asked that the condition read to require a building-permit application be submitted by the deadline (language changed from “obtained” to “applied for”) to account for the time needed to prepare construction documents. Nash and the board confirmed that filing a building-permit application by the deadline would not allow indefinite delay; subsequent expiration or revocation would be governed by whatever county code provisions applied at the time of expiration.

Commissioner Casanelli moved to approve the amendment; Commissioner Hockaday seconded. The motion passed 5-0.

The amendment applies only to the casino special-use permit; the board was told the hotel expansion and other potential future uses are separate entitlements. The item was presented as PLZ 2025063 on APN 016-401-97 and was presented to the board after the county approved a related rezoning on Sept. 4.
