The New Shoreham Planning Board on Sept. 10 advised the Zoning Board to grant a variance and special‑use approval for Muddy Paws LLC to reconfigure the first floor and add a second floor at 149 Old Town Road (Plat 6, Lot 72), conditioned on adding width and depth dimensions to the building plans to show that the existing footprint will not change.
The advisory matters because the applicants said the project will not expand the building footprint but will add a second story to an existing three‑building condominium lot abutting Mill Hill Swamp and Pond. Planning Board members asked the applicants to ensure the record and future permit reviews explicitly show the footprint did not change.
Applicant Deborah Frost and co‑applicant Christopher DeCaro described the project as “taking an existing property with the existing footprint” and replacing the first floor and adding a second floor without enlarging the footprint. Planning Board member Gail Hall said the board needed dimensions on the plans so “it shows forever that you did stay within your footprint, and there would be no question in the future.”
Board members noted the property previously received a special‑use permit that is recorded in the land evidence records (book 364, page 127) and that prior variances had been granted for unit counts on the lot. The applicants confirmed they already had Historic and Technical Commission review for siding, windows, deck materials and height. The board’s motion explicitly required that the width and depth of the building, and deck dimensions as applicable, be added to the building plans prior to zoning review so the unchanged footprint is documented.
Gail Hall made the motion to send a favorable advisory with the stated findings of fact and the condition that dimensions be added to the plans. The board approved the motion and the advisory will be forwarded to the Zoning Board for its decision.
The board did not record additional conditions beyond the plan‑dimension requirement at the Planning Board level; any further conditions would be imposed by the Zoning Board if it acts on the application.
