Wayne County adopts easements, covenants for Business Campus; county to convey Lot 2 to development alliance

The Wayne County Board of Commissioners voted Sept. 16 to approve a declaration of easements and restrictions and to convey a build-ready lot and a strip of common area at the Wayne County Business Campus on Patetown Road.
County staff described the document as a set of recorded covenants that will govern shared maintenance responsibilities for the campus's common areas, notably a large stormwater retention pond that serves the Phase 1 lots. The declaration assigns responsibility for "repairing, replacing, and cleaning" signs and landscaping, maintaining access easements and, most significantly, operating and maintaining the stormwater system. Staff said those maintenance obligations will be apportioned by acreage once lots are sold.
"Once all these lots are sold out, what we will do is create an owners association who would oversee maintenance of that," the staff member said, noting that Wayne County currently will bear the responsibility until a private owners association is established.
The board approved the covenants with a technical direction to insert the final recorded reference to the plat before the recorded covenant is finalized. The covenants are effective through June 30, 2054, with automatic five-year extensions thereafter unless amended.
Commissioners also approved conveying Lot 2 (under contract with the ABC board for a distribution warehouse) and a 0.38-acre common-area parcel adjacent to TA Loving to the Wayne County Development Alliance to facilitate sale and improvements. Staff said the 0.38-acre area includes a ditch that TA Loving has agreed to improve and maintain so future owners of the campus will not be responsible for that small area.
Staff emphasized the campus's selling points: Phase 1 already includes off-site stormwater improvements, allowing buyers to develop with higher impervious coverages, and sites will be industrial-zoned with no additional architectural covenants beyond those in the cityordinance. "That's a selling point," a staff member said.
The board voted unanimously to approve the declaration and the conveyance; staff said the final plat references will be inserted into the recorded documents before filing with the Register of Deeds.
The actions clear the way for the Wayne County Development Alliance to move forward with marketing and the ABC board's planned warehouse development on Lot 2.
