Planning board schedules Street Legal LLC preliminary plan for Sept. 25 special meeting, contingent on electronic submission and completeness

The Tiverton Planning Board voted Sept. 9 to place Street Legal LLC’s preliminary-plan review on the board’s special meeting agenda for Sept. 25, provided the applicant submits an electronic version of the preliminary plan and planning staff can certify the application complete in time to issue required 14-day notices.

Applicant counsel explained the project is a major land development: a 29,600-square-foot, two-story building (a car garage) and an additional parking lot with 79 spaces on AP 107, Lots 813–818. The applicant requested a special meeting and initially sought a combined preliminary/final plan review; counsel withdrew the combined-review request and confirmed the team prefers to proceed to a preliminary-plan hearing at the Sept. 25 special meeting so construction could begin before winter if permitting and approvals permit.

Planning staff and the board emphasized the need for an electronic submittal to allow staff time to certify completeness and prepare abutter notices and public advertising. The applicant agreed to deliver the electronic materials the evening of Sept. 9 and staff agreed to attempt certification by the following day. The board conditioned adding the item to the Sept. 25 agenda on staff certifying completeness and on the ability to issue legal notice and abutter notifications.

Board action: A motion to add the Street Legal LLC preliminary-plan review to the Sept. 25 special meeting agenda passed unanimously; the matter is contingent on certified completeness and timely notice.
