The council appointed Deputy City Clerk Bertha Augustine as interim city clerk after elected Clerk Lina Martinez resigned because of an employment conflict with another city.
City Attorney Megan presented the legal basis for an interim appointment under California Government Code section 36512 and recommended appointing Augustine; staff said the appointment would not create immediate fiscal impact as the mayoralty stipend for the clerk would be the same. Council members expressed concern about double compensation because Augustine already receives pay for deputy city clerk duties and other assignments. The city manager was directed to review compensation implications and return to council if additional pay beyond existing compensation is proposed.
Council carried the appointment by motion and roll call; the motion approved the appointment and instructed the manager to notify council if any additional compensation is to be paid. The appointment will last until the next applicable election unless the council decides otherwise after review of options for an elected versus appointed clerk.
