Commission approves zoning amendment for 2903 S. Kansas ahead of annexation

The Newton Planning Commission voted to approve a zoning classification change for property at 2903 South Kansas Avenue on Sept. 8. The approval is a prerequisite to an anticipated annexation and will be transmitted to the City Commission for consideration at its Sept. 23 meeting.
Staff explained the applicants—Craig Sedo, Rita Hernandez and Francisco Delgado—seek to reclassify the property from Rural Single-Family Residential to Single-Family Dwelling District. The commission discussed five statutory criteria (consistency with the comprehensive plan and other policies; compatibility with surrounding uses; availability of water, sewer and services; correction of an error; and changed conditions). Staff emphasized that rezoning allows any use permitted in the requested district and that future uses cannot be restricted to the applicant’s stated intent alone.
Commissioners reviewed mapping and noted utilities adjacent to the site; staff said public water lines are available and utilities can be extended to serve permitted uses. After a brief public hearing with no speakers, a commissioner moved approval; the motion passed by voice vote. The approval will be forwarded to the City Commission for final action on Sept. 23.
