Depew planning board recommends special-use permit for smoke and vape shop at 6061 Transit Road

The Village of Depew Planning Board on Sept. 4 recommended by a 5-0 vote that the Village Board grant a special-use permit for a smoke and vape shop at 6061 Transit Road, Unit 6063.
Applicant Ahmed Saleh said the proposed business would sell vaping products and related retail items, plus packaged convenience goods and branded apparel; he told the board the business would not prepare food and would not conduct mail-order sales. Village staff confirmed the applicant must return to the board to renew the permit after one year and that no engineering objections were identified during review.
During questions from the public, resident Paul Sprott asked about the lease term and plaza ownership; Saleh said the lease is for five years with five five-year options and identified Nickel City Enterprises as the plaza owner. Saleh told the board he operates other similar businesses in the area and said, “I have never had any violation. I never had any ticket. Everything's fine with it.”
Board members asked whether the business would offer prepared food and whether the applicant had prior police involvement; staff noted the applicant had represented that prior stores had no police issues and that the applicant had reviewed applicable village code rules and limitations. Code enforcement and engineering staff reported no objections on the record. There were no public objections during the meeting.
Member Soja moved, and Member Fedorowicz seconded, a motion to recommend that the Village Board grant the special-use permit as submitted. The board recorded a roll-call vote with Member Soja, Member Fedorowicz, Member Matuszak, Member Spencer and Chairman Maciaski voting yes; the motion carried 5-0.
The planning board’s recommendation is advisory; final approval rests with the Village Board. The board noted the permit will require annual renewal and that the applicant must comply with all applicable village codes and any conditions imposed by the Village Board.
