The Newton County Board of Commissioners approved a conditional-use permit to operate an automobile sales dealership at 3198 Salem Road (CUP25-000008), a 1.17-acre parcel in the Salem Overlay Tier 2.
Planning staff told the board the site was developed as an auto dealership in 2001 and operated until COVID-era closures. Georgia Department of Transportation purchased a portion of the property for the Salem Road widening project, taking about 50 feet of right-of-way and reducing the site’s parking from roughly 80 spaces to about 46, staff said. Staff recommended approval because the site was previously used as an auto sales facility and the proposed use meets applicable standards in Section 510-105 of the Newton County Unified Development Ordinance for automobile sales and rental.
Applicant representatives and counsel argued the petition meets the county’s special‑use criteria and overlay requirements. John Nicks, speaking for the applicant, noted the building’s age and history, said the indoor space (approximately 1,800 heated square feet) remains in good condition, and confirmed the applicant would comply with staff conditions.
The board approved the CUP with the staff-recommended conditions. Those conditions, included in the staff packet and adopted by the board, prohibit service, salvage, abandonment or temporary storage of vehicles on site; require outside speakers to be at least 250 feet from residential districts and to meet the county noise ordinance; require buffers/fencing per the zoning ordinance; require downcast cutoff outdoor lighting; require a county business license and an approved fire inspection from the Newton County Fire Marshal prior to release of a business license; and require any exterior renovations to meet Salem Overlay architectural standards.
The planning commission had recommended denial by a 3–1 vote; no public opposition was recorded at the county hearing. The board’s motion to approve carried as recorded in the meeting transcript.
