Summary
The board approved Ordinance 25‑18 establishing the Pineapple Grove Community Development District with developer commitments to provide buyer disclosure statements and to add a resident member to the CDD board after 15% of lots are platted and sold; the ordinance passed 3–2.
The Board of County Commissioners adopted Ordinance 25‑18 to establish the Pineapple Grove Community Development District, approving special conditions proffered by the developer that expand disclosure and provide for early resident representation on the district board.
County attorney Catherine Barbieri summarized the petition and the special conditions agreed by the developer: (1) the district must make public financing and maintenance information available to existing and prospective residents; (2) initial contracts of sale for parcels and residential units must contain a boldfaced disclosure statement notifying buyers that the district may impose taxes or assessments to pay for construction, operation and maintenance of district facilities and services; and (3) when 15% of planned lots are platted and sold to end users, the landowners will cause one seat on the CDD board of supervisors to be filled by a qualified elector of the district—an earlier resident representation than the statutory default.
Jerry Erlewine, representing the petitioner, said he was available to answer questions. Commissioners discussed management concerns common to CDD formations and welcomed the developer’s additional safeguards. The measure passed 3–2 with Commissioners Clasby and Lowry recorded as opposed; Commissioners Lee, Townsend and Fowler voted in favor.
Why it matters: CDD formation creates a special district with taxing and assessment authority to finance and maintain infrastructure for a new development; the developer‑negotiated disclosures and earlier resident representation are intended to increase transparency and resident participation.
Ending: The ordinance will be implemented per its terms and the developer’s proffers; county staff will follow up on the disclosure language and recordation requirements associated with new property sales within the district.
