Policy committee pauses change to virtual‑attendance rule and asks solicitor for legal review

The Boyertown Area School District policy committee paused revision of its electronic attendance policy and asked the district solicitor to review legal limits on remote participation.

Committee members discussed policy 6.1 (board member attendance and electronic communications) and whether the policy should allow more than two board members to attend meetings remotely. “I think the first question is, what does the board wanna do with this in terms of from a practical perspective? But second of all, we can double check this to make sure legally there's not gonna be any issues,” the district solicitor said.

Speakers raised practical concerns about public access and quorum. One board member said she would not be comfortable with board meetings where a majority of members were absent from the meeting room, noting public perception and confidentiality for executive sessions. Another member asked if illness and vacation should be treated differently; the solicitor cautioned legal distinctions cannot easily be drawn between reasons for remote attendance.

The committee took an informal sense of the group about allowing up to four members to participate virtually if at least five members were physically present; several members indicated support but committee leadership requested a formal legal opinion before making a policy change. The presenter said staff would return with counsel’s advice in short order.

Outcome: policy 6.1 was held for further information and legal review; staff and counsel will return to the committee with recommended language and guidance.
