The Franklin County Board of Commissioners voted to approve a settlement with Correll Brands LLC releasing the company from owing $2,500 in Tier II hazardous-materials planning fees.
County staff told the commissioners the Department of Emergency Services annually invoices facilities for Tier II planning fees — used to support hazardous-materials emergency planning and response — and pursues delinquent accounts through legal outreach when voluntary payment is not obtained. “If that's not successful, we end up with a complaint, and this is a settlement on one of these complaints,” County staff said.
The county solicitor and the county’s enforcement staff were present for the item. Commissioners asked few questions about the matter; the chair called for a motion and the board approved the settlement by voice vote.
The fees support local planning for responses to major hazardous-material releases and are calculated from self-reported information provided by the facilities, staff said. The county indicated similar delinquency cases remain in the pipeline.
The approval was taken during the regular agenda and recorded as a motion that passed by voice vote; the record did not list a roll-call tally.
The board moved on to other business following the vote.
Notes: the settlement amount and program are those stated in the public meeting record.
