The Kamas City Council on Sept. 23 unanimously adopted Ordinance 2025‑09, amending the municipal code to add definitions and regulations for body‑art facilities and to update parking and allowed‑use tables for relevant commercial and light‑industrial zones.
The ordinance adds or revises definitions for “body art,” “body art facility” and “tattoo”; removes permanent makeup (cosmetic tattooing) from the body‑art definition; combines ear piercing and body‑piercing language into a single definition; and adds facility regulations including a provision addressing body art performed on minors.
During the meeting staff summarized changes made after public hearings and prior council review. Councilmembers asked one clarifying question about the minors provision: whether the ordinance should require that body art performed on minors “comply with the Utah State Code” rather than cite a specific code section that might change. Staff and council agreed to replace the section reference with the broader phrase “shall comply with the Utah State Code.” Councilmember Wes Lee moved to pass the ordinance with that change; the motion passed unanimously.
Ordinance 2025‑09 modifies multiple code sections, including definitions (15.02.010), parking requirements in the general commercial (15.14.0.06), light industrial (15.15.0.06), entry corridor commercial (15.17.0.06) zones, and the Appendix B allowed‑use table (15.3.0.02). The city staff recommendation removed certain exemptions (for example, specific ear‑lobe piercings) and adjusted the allowed uses so body‑art facilities are expressly allowed in the listed commercial and industrial zones.
Councilmembers indicated the item had been thoroughly discussed at an earlier meeting and at the planning commission public hearing on Aug. 5. The council did not receive public testimony during this agenda item at the Sept. 23 meeting. The ordinance will take effect per the city’s standard ordinance effective‑date procedures.
The council’s approval included direction for city staff to update the codified municipal code language to reflect the agreed phrasing for minors and to publish the adopted ordinance number and text.
