Tabled minutes
The council voted to table approval of the minutes dated Aug. 21 to allow corrections to be made. Council Member Hill moved to table the minutes and Council Member Flowers seconded; the motion carried by voice vote.
Selection of city legal counsel
The council voted to award the city’s general-counsel contract to Wilson and Wilson, PLLC. The motion—moved by Council Member Flowers and seconded by Council Member Marconi—included a provision to retain outgoing attorney Reed Richards on a transitional basis until he confirms his departure. Representatives from the firm had attended council sessions and answered questions about ordinance enforcement and code tools prior to the vote.
Authorization to draft oversized-structure amendment
The council authorized staff to draft an amendment to HCC 10-2b-6 (oversized structures/ADU size) reflecting planning commission recommendations and the council’s guidance. Council Member Ryan D. Wilcox moved the item and Council Member Hill seconded; the motion passed. Staff will return a formal ordinance for council review and the city attorney will prepare final ordinance language.
Adoption of stormwater ordinance (Ordinance 2025-04)
The council adopted Ordinance No. 2025-04, an update to the city’s stormwater code language that the city’s recent audit recommended the council formalize. Because this was an ordinance vote, the council conducted a roll-call vote. Council Member Wilcox, Council Member Hill, Council Member Marconi, Council Member Northrecht and Council Member Silvers each voted “aye” and the ordinance carried.
Other procedural motions
At the close of the meeting a motion to adjourn was made by Council Member Marconi and seconded by Council Member Fowler; the motion carried.
What’s next
Staff will prepare the drafted HCC 10-2b-6 amendment for a future meeting and the new city attorneys will assume contract duties subject to the transition arrangements discussed on Sept. 18.
