The commission reviewed draft public notices for 824 North Fourth Street in Burlington and 538 North C Street in LeRoy. County counsel and staff said the notices describe a public live auction administered by Von Ross Land Brokers (Cameron Ross) with bidding available in person and remotely. The advertisement materials submitted to the board state the auction will finish Oct. 30, 2025, at 7 p.m. in the courthouse lobby; the board set a public hearing on any sale for 10 a.m. Monday, Nov. 3, 2025.
“No reserve” marketing and commission: Staff explained the marketing plan contemplates listing the properties without a reserve and engaging a broker for marketing and the auction process. The draft notice includes a commission provision: up to 5% total commission for Von Ross Land Brokers not to exceed $5,000 in the aggregate for both properties. Staff said the broker will prepare auction listing agreements and handle bidder verification and sale administration.
How the process will work: As described to commissioners, the broker will conduct the auction on Oct. 30. If the broker identifies a successful bidder, the broker will present the results to the board at the Nov. 3 public hearing; the board may accept or reject the sale at that hearing. County staff said that format mirrors prior county property sales handled by third-party auction administrators.
Board action and context: Commissioners approved a motion to publish the notices and proceed with the auction/marketing plan (moved by Commissioner Abendroth; seconded by Commissioner McCurry). At least one commissioner noted that published appraised values on the county website may not reflect the current condition of the properties and urged realistic expectations for sale proceeds.
Next steps: Staff will finalize the notices and the auction listing agreement with Von Ross Land Brokers, publish the notices in the county legal paper as required, and return the results to the commission at the Nov. 3 public hearing.
