After a separately noticed closed session on Sept. 11, the Fresno City Council directed the city attorney to prepare litigation in the form of an unfair-bargaining claim to be filed with the State Public Employment Relations Board (PERB).
City Attorney counsel read the closed-session report: the vote to direct litigation was 3 in favor and 1 opposed. Council Members Arias, Richardson and Vang voted in favor; Council Member Perea voted no. Council Members Esparza, Maxwell and Council President Carvassi were absent for the special meeting vote. The report stated the action is taken under Government Code section 54957.1 and that the defendant will be named if and when the action is formally commenced.
No additional details about the target of the potential claim were announced at the meeting; the city attorney said the defendant will be announced if the city files the action.
